Fred K. Herrmann is a Member of Kerr, Russell and Weber, PLC. He is a graduate of the United States Naval Academy and the University of Michigan Law School.
Mr. Herrmann is a litigator in the areas of commercial and complex litigation, with particular experience in attorney liability defense, class action defense, securities, antitrust, patent and other intellectual property litigation, insurance coverage, sales representative commissions, contract disputes, and multidistrict litigation, as well as supply chain and other disputes implicating the Uniform Commercial Code. Mr. Herrmann has tried cases in state and federal courts, and has filed briefs and argued cases in state and federal appellate courts.
His cases have broadly spanned the commercial and industrial spectrum, involving a wide variety of statutory and common law claims. Representative clients include major law firms, insurance companies, computer systems manufacturers, software developers, pharmaceutical companies, dietary supplement companies, beverage manufacturers and distributors, recording industry firms, tire manufacturers, manufacturers of specialized textiles, automotive OEMs and suppliers, automotive dealerships, emissions testing equipment manufacturers, oil and gas companies, NASCAR race teams, hospitals, aviation firms, banks and commercial lenders, municipalities, retailers, industrial machinery brokers, land developers, religious organizations, franchisors, wireless communications companies, accounting firms and manufacturers of explosives.
Mr. Herrmann currently represents the Third Judicial Circuit in the State Bar Representative Assembly, the final policymaking body of the State Bar. He also serves as a Council Member of the State Bar Antitrust, Franchising and Trade Regulation Section. He recently completed two consecutive terms as the chair of that Section. He is a member of the State Bar of Michigan and is admitted to practice before the United States District Court, in both the Eastern and Western Districts of Michigan and the Courts of Appeals for the Sixth and Federal Circuits. He is also a member of the American and Federal Bar Associations.
While at the Michigan Law School, Mr. Herrmann was an editor of the Michigan Journal of International Law. He frequently serves as a judge for moot court competitions at both the Michigan Law School and Wayne State University School of Law.
After graduating from the Naval Academy, Mr. Herrmann served as a logistics officer in the United States Marine Corps from 1988 to 1993 (active duty) and from 1993 to 1996 (reserve). From 1990-1991 he deployed overseas with Second Battalion, Ninth Marines, an infantry battalion, and then served on the logistics staff of the First Marine Division, Camp Pendleton, California. As a reservist he served with Detroit’s own First Battalion, Twenty-fourth Marines, as a logistics officer and H&S Company Commander. He currently serves as a member of U.S. Congressman Thaddeus McCotter’s Service Academy Review Committee.
