Robert A. Marsac is of counsel to Kerr, Russell and Weber, PLC, specializing
in complex, multi-party and class action litigation. He has extensive
experience in products liability, toxic tort, environmental, employment,
pension, trade secret, general business and insurance-related matters
including claims negotiation, counseling and coverage issues. Mr. Marsac
frequently advises clients regarding business acquisitions and other
strategic initiatives. Mr. Marsac has been involved in a variety of high
profile disputes and controversies and most recently has been involved in
business and trade association issues related to the constitutionality of
laws which either benefit or restrict business or trade association members.
Among the matters in which Mr. Marsac has been involved over the years,
include, the defense of a nationwide class action alleging age and sex
discrimination; defense of two nationwide class actions challenging a major
retailers’ health care program; serving as co-counsel in the prosecution of
an insurance coverage dispute resulting from the denial of coverage for
breast implant claims, ultimately resulting in recovery of approximately $2
billion; counseling an insured in the negotiation of insurance recovery as a
result of a powerhouse explosion; counseling an insured in the negotiation
of an insurance recovery as a result of a nuclear powerhouse turbine
failure; serving as claims counsel for a captive insurance company; the
prosecution of a challenge to the constitutionality of waste disposal
restrictions as a result of state law and local ordinances; the prosecution
of challenges to the constitutionality of state practices and procedures in
connection with Medicaid benefits; the defense of several cases challenging
issuance of gaming licenses in the City of Detroit; the defense of thousands
of breast implant claims; defense of thousands of asbestos claims; the
defense of trade secret claims in connection with development of fuel cells
and the defense of a pharmaceutical manufacturer as the result of alleged
industry price fixing.
Mr. Marsac frequently lectures on litigation prevention, case management
and insurance-related topics. He received his Bachelor’s Degree from Oakland
University in 1969 and graduated with honors from the Wayne State University
Law School in 1973, including the Marx Scholarship, membership in the
MacKenzie Honor Society, the Moot Court Board and the National Order of the
Barristers. As a member of Wayne State’s National Moot Court Team, Mr.
Marsac participated in regional and national moot court competitions. While
at Wayne State, Mr. Marsac served as student body president. Mr. Marsac is a
member of the State Bar of Michigan, the Detroit Metropolitan Bar
Association and the American Bar Association and is a Fellow of the Michigan
State Bar Foundation. He is admitted to practice in the Sixth and Seventh
Circuit Courts and before the United States Supreme Court. He is also an
officer and trustee of the Detroit Science Center.
